Terms of Service
By accessing or using Dirt Race Hub (“Dirt Race Hub,” “we,” “our,” or “us”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1. Platform Role
Dirt Race Hub is a technology platform that facilitates:
- Track and event listings
- Public pre-entry registration
- Recording cash payments collected by Track Operators
- Walk-up order desk operations and gate-confirmation verification
- Orbits participant exports
Dirt Race Hub does not organize, operate, supervise, or control race events. All events are operated by independent track operators (“Track Operators”).
2. Registration on Behalf of Others
Registration may be completed by:
- A racer
- A parent or legal guardian
- A crew or team representative
- An authorized agent
If you register a racer (adult or minor), you represent and warrant that:
- You have legal authority to act on their behalf
- You have authority to agree to these Terms and any applicable waiver
- All submitted information is accurate
If registering a minor, you represent you are the minor’s legal parent or court-appointed guardian with authority to consent.
Dirt Race Hub may rely on these representations and is not responsible for independently verifying authority.
3. High-Risk Activity Acknowledgment
By registering for or participating in an event, you acknowledge:
- Participation is voluntary
- All risks are assumed by the participant
- Dirt Race Hub is not responsible for event safety, track conditions, officiating, or operations
Dirt Race Hub has no control over event execution.
4. Track Operator Responsibility
Track Operators are solely responsible for:
- Event safety and operations
- Rules and eligibility decisions
- Technical inspections
- Insurance coverage
- Refund policies
- Any waiver drafting, administration, and enforceability required for the event
- Compliance with applicable laws and sanctioning rules
Dirt Race Hub is not liable for Track Operator actions or decisions.
5. Payments
Racer payments recorded at the Dirt Race Hub desk are cash transactions collected directly by the Track Operator. Stripe processes Track Operator subscriptions to Dirt Race Hub.
- Dirt Race Hub does not store full credit card numbers.
- Dirt Race Hub does not process racer card payments.
- Racer refunds are determined and handled solely by the Track Operator.
Dirt Race Hub is not responsible for disputes involving racer payments collected by a Track Operator.
6. Waivers
Dirt Race Hub does not provide electronic waiver signing or storage. Dirt Race Hub:
- Does not provide legal advice
- Does not guarantee waiver enforceability
- Does not verify guardian authority beyond the representations racers or their guardians provide
Track Operators are solely responsible for confirming a racer’s waiver status before permitting them to compete, and for waiver legality and compliance generally.
7. Public Race-Day Information
Driver name, car number, and class information you submit may be visible to track staff for registration and check-in and may be included in a participant file the Track Operator exports to Orbits. Dirt Race Hub does not publish a public entry list or results page.
8. Media & Sponsor License
By registering for or participating in an event, you grant the Track Operator, its sponsors, sanctioning bodies, and Dirt Race Hub a perpetual, worldwide, royalty-free license to use the participant’s name, image, likeness, voice, results, and biographical information in photographs, video, livestreams, broadcasts, promotional materials, advertising, social media, and archival content related to the event or motorsports activities, without compensation or further approval.
If registering on behalf of another person, you represent that you have authority to grant this license on their behalf.
9. Insurance (Track Operators)
Track Operators represent that they maintain commercially reasonable insurance appropriate for motorsports events.
Dirt Race Hub is not an insurer and does not verify coverage.
Track Operators agree to indemnify Dirt Race Hub for claims arising from event operations.
10. Limitation of Liability
To the maximum extent permitted by law, Dirt Race Hub is not liable for:
- Personal injury or death
- Event cancellations or delays
- Disqualifications
- Rule disputes
- Track Operator negligence
- Insurance disputes
- Lost profits, sponsorships, or prize money
Dirt Race Hub shall not be liable for indirect, consequential, incidental, or punitive damages.
11. Indemnification
Track Operators agree to indemnify and hold harmless Dirt Race Hub from claims arising from:
- Event operations
- Participant injury
- Youth participation
- Failure to maintain insurance
- Improper waiver implementation
Users registering on behalf of others agree to indemnify Dirt Race Hub if they lacked proper authority to bind the participant.
12. Arbitration & Governing Law
TODO(keith): confirm governing law, arbitration venue, and dispute-resolution provider for Dirt Race Hub before publishing — this may not be the same operating entity or jurisdiction as raceselect.com's Kentucky/AAA arbitration terms.
13. Changes
Dirt Race Hub may update these Terms at any time. Continued use constitutes acceptance of changes.
